The Manor Of Monks Hall in Gosberton in
the County Of Lincoln
Be it remembered that on the 22nd day
of December in the year of our Lord one thousand eight hundred and forty
eight Benjamin Smith of Horbling in the County of Lincoln Gentleman,
Benjamin Smith of Monks Hall in the parish of Gosberton in the said county
Grazier and Edward Smith of Bicker in the said county Grazier Customary or
Copyhold Tenants of the said Manor and surviving devisees in trust named in
the will and codicil of Francis Smith late of Monks Hall aforesaid Gentleman
deceased in pursuance of a covenant and agreement entered into in and by an
indenture bearing date the eleventh day of Octlber last and made between the
said Benjamin Smith of Horbling, Benjamin Smith of Monks Hall and Edward
Smith of the first part, Ann Smith of Monks Hall aforesaid widow and relict
of the said Francis Smith of the second part the said Benjamin Smith of
Monks Hall the said Edward Smith and Henry Smith of Horbling aforesaid
Grazier of the third part and the Reverend Henry Harris of Horbling
aforesaid Clerk of the fourth part did out of court surrender by the rod out
of their and each and every of their hands into the hands of the Lord of the
said Manor by the hands and acceptance of George Wiles Steward of the Courts
of the said Manor according to the customer thereof all that parcel of land
containing by estimation three roods but by admeasurement two roods and
twenty five perches (more or less) lying and being in Quadring aforesaid in
a parcel of land formerly part of Pode Hall Fields between Pode Hall Land or
lands late of the said Francis Smith and now belonging to the said Benjamin
Smith of Monks Hall on or towards the east freehold lands late of Daniel
Baldwick since of the said Francis Smith and now belonging to the said
Benjamin Smith of Monks Hall to which this lies open on or towards the south
Sarah Gate on Mill Lane on or towards the west and freehold lands late of
the said Daniel Baldwick since of the said Francis Smith and now belonging
to the said Benjamin Smith of Monks Hall to which this lies open on or
towards the north and also all that parcel of land containing by estimations
half an acre but by admeasurement one acre and twelve perches (more or less)
lying and being in Quadring aforesaid in the said parcel of land formerly
part of Pode Hole Field between Pode Hole Lane or lands late of the said
Francis Smith and now belonging to the said Benjamin Smith of Monks Hall on
or towards the east freehold lands late of the said Daniel Baldwick since of
the said Francis Smith and now belonging to the said Benjamin Smith of Monks
Hall to which this lies open on or towards the south Sarah Gate or Mill Lane
on or towards the west and freehold lands late of the said Daniel Baldwick
since of the said Francis Smith and now belonging to the said Benjamin Smith
of Monks Hall to which this lies open on or towards the north. And also all
that piece or parcel of land or ground containing one rood and seventeen
perches (more or less) lying and being in Quadring aforesaid in the said
parcel of land formerly part of Pode Hole Field between Pode Hole Land or
lands late of the said Francis Smith and now belonging to the said Benjamin
Smith of Monks Hall on the east freehold lands late of the said Daniel
Baldwick since of the said Francis Smith and now belonging to the said
Benjamin Smith of Monks Hall on the north and south and Sarah Gate or Mill
Lane on the west all which lands are now in the occupation of Benjamin Smith
of Monks Hall and to which the said Benjamin Smith of Horbling Benjamin
Smith of Monks Hall and Edward Smith together with Benjamin Wilkinson now
deceased were admitted at a court held for the said manor on the fifth day
of December one thousand eight hundred and forty five as devises of the said
Francis Smith together with all and singular the hedges ditches fences ways
paths passages waters watercourses rights members whatsoever to the said
lands and hereditaments belonging or appertaining And the reversion and
reversions remainder and remainders rents issues and profits thereof And all
the estate right title interest inheritance use trust possession property
claim and demand whatsoever of them the said Benjamin Smith of Horbling
Benjamin Smith of Monks Hall and Edward Smith and of each and every of them
both at law and in equity therein and thereto freed and discharged of and
from all trusts powers and directions declared and contained concerning the
same in and by the said will and codicil of the same Francis Smith deceased
or either of them to the uses hereinafter expressed of and concerning the
same that is to say As to one equal undivided third part or share thereof to
such uses upon such trusts and for such intents and purposes as the said
Benjamin Smith of Monks Hall shall from time to time or at any time or times
hereafter by any deed or deeds direct or appoint And in default of and until
any such direction or appointment shall not extend to the use of the said
Benjamin Smith of Monks Hall his heirs and assigns for ever And as to one
other equal undivided third part or share thereof to such uses upon such
trusts and for such intents and puposes as the said Edward Smith shall from
time to time or at any time or times hereafter by any deed or deeds direct
or appoint and in default of and until any such direction or appointment and
so far as any direction or appointment shall not extend to the use of the
said Edward Smith his heirs and assigns for ever And as to the remaining one
equal undivided third part or share thereof to such uses upon such trusts
and for such intents and purposes as the said Henry Smith shall from time to
time or at any time or times hereafter by any deed or deeds direct or
appoint and in default of and until any such direction or appointment and so
far as any such direction or appointment shall not extend to the use of the
said Henry Smith his heirs and assigns for ever to be held at the will of
the Lord according to the custom of the said Manor and by the rents suits
and services therefore due and of right accustomed
